These Terms of Service ("Terms") govern your use of BOMACARE's website, mobile experience and related services (the "Services"). By creating an account, booking care, applying as a professional or purchasing supplies, you agree to these Terms. If you do not agree, please do not use the Services.
1. About BOMACARE
BOMACARE is a home-based care coordination and medical-supplies platform operating in Kenya. We connect customers with vetted nurses, caregivers, occupational-health officers, allied health professionals and grooming professionals, and we sell selected medical and personal-care supplies.
2. Eligibility
You must be at least 18 years old and able to enter into a binding contract under Kenyan law. Care for minors must be booked by a parent or legal guardian.
3. Accounts
- Provide accurate, current information and keep it up to date.
- Keep your login credentials confidential. You are responsible for activity under your account.
- Notify us promptly of any unauthorised use.
4. Care bookings
- Booking requests are confirmed by a BOMACARE coordinator; we may decline or reschedule where safety, capacity or licensing requires.
- You must give an honest description of the care recipient's condition and environment so the right professional is assigned.
- Professionals are expected to work within the scope of their qualifications and Kenyan regulatory requirements (including the Nursing Council of Kenya where applicable).
- You agree to provide a safe, respectful working environment for our professionals.
5. Medical disclaimer
The Services do not replace emergency medical care. If you or the care recipient is experiencing a medical emergency, call 999 or go to the nearest hospital immediately. Care notes, guides and content on the Services are for information only and are not a substitute for professional medical advice, diagnosis or treatment.
6. Professional applications
- Applications are subject to vetting, including verification of national ID, licence, references and police clearance.
- Approval is at BOMACARE's discretion and may be revoked for cause, including safeguarding concerns.
- Approved professionals agree to follow BOMACARE's code of conduct, care standards and confidentiality obligations.
7. Shop, payments and delivery
- Prices are shown in Kenya Shillings (KES) and, where applicable, include VAT.
- Payments are processed through third-party providers (e.g. mobile money, card). BOMACARE does not store full card details.
- Delivery timelines are estimates. Title in retail goods passes on delivery; risk passes when goods are handed to you or your representative.
8. Cancellations and refunds
You may cancel a care booking free of charge up to a reasonable window before the scheduled visit; late cancellations may incur a fee. Retail goods may be returned where defective or where required by the Consumer Protection Act, 2012. Contactinfo@bomahomecare.careto request a refund.
9. Communications
By using the Services you agree to receive operational communications (booking confirmations, schedule changes, visit reminders, order updates, OTP and security alerts) by SMS, WhatsApp, email or push. Promotional messages are sent only where you have opted in and you may opt out at any time from your notification preferences.
10. Acceptable use
- Do not misuse the Services, attempt to interfere with them, or use them for unlawful purposes.
- Do not impersonate anyone or misrepresent your qualifications as a professional.
- Do not upload content that is unlawful, defamatory or infringes another person's rights.
11. Intellectual property
BOMACARE and its licensors own all intellectual property in the Services. You are granted a limited, non-exclusive, non-transferable licence to use the Services for their intended purpose.
12. Liability
To the fullest extent permitted by Kenyan law, BOMACARE's aggregate liability arising out of or in connection with the Services is limited to the amounts you paid to us in the twelve months preceding the event giving rise to the claim. Nothing in these Terms limits liability that cannot lawfully be limited (for example, for death or personal injury caused by negligence).
13. Governing law and disputes
These Terms are governed by the laws of Kenya. The courts of Kenya have exclusive jurisdiction, subject to any right you may have to refer a consumer dispute to the relevant regulator.
14. Changes
We may update these Terms. Material changes will be highlighted in-app or by email. Continued use after the effective date constitutes acceptance.
