1. Relationship
You engage with BOMACARE as an independent professional, not as an employee. Nothing in these terms creates an employment, partnership or agency relationship.
2. Assignments
- Assignments are offered on a per-visit or per-shift basis via the BOMACARE app.
- You may accept or decline assignments, subject to responding within the stated window.
- Once accepted, the assignment is a professional commitment; late cancellation may affect future offers.
3. Fees and payment
Fees per assignment are shown before acceptance. BOMACARE settles fees to your registered M-Pesa or bank account according to the published pay-out schedule, net of applicable withholding and platform fees where disclosed.
4. Tools and equipment
You supply your own basic uniform (unless issued), watch, pen and personal PPE. BOMACARE provides case-specific consumables where the care plan requires.
5. Compliance
- Maintain your professional licence, indemnity and any regulatory CPD requirements.
- Follow the Provider Code of Conduct and all BOMACARE clinical protocols.
- Comply with the Kenya Data Protection Act, 2019 in respect of any client information you handle.
6. Non-solicitation
For 12 months after your last assignment, you agree not to solicit or accept private engagement from any BOMACARE client you were introduced to through the platform.
7. Intellectual property
Care notes and records created during BOMACARE assignments belong to BOMACARE and the client. You retain your own general professional know-how.
8. Suspension and termination
BOMACARE may suspend or terminate access for breach of these terms, safety concerns, complaints under investigation, or loss of professional registration.
9. Governing law
These terms are governed by the laws of Kenya, and disputes are resolved in Nairobi courts, subject to any mandatory alternative dispute resolution.
